Welcome to HipDeck! These Terms of Use ("Terms") govern your access to and use of HipDeck's platform, services, and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.
1. Use of the Service
a. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms, or that you have obtained consent from a parent or guardian if you are under 18.
b. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
c. Acceptable Use
- Use the Service for any unlawful purpose.
- Upload or distribute any content that is harmful, illegal, or violates the rights of others.
- Interfere with or disrupt the Service or any networks connected to the Service.
- Attempt to gain unauthorized access to the Service or related systems.
2. Subscription and Payment
a. Subscription Plans
Some features of the Service require a paid subscription. You agree to pay all applicable fees associated with your subscription plan.
b. Payment Processing
Payments are processed through Stripe, our payment provider. By subscribing to a paid plan, you agree to Stripe's terms and authorize us to charge your payment method.
c. Renewal and Cancellation
Subscriptions automatically renew unless canceled before the end of the billing period. You may cancel your subscription through your account settings. Cancellation takes effect at the end of the current billing cycle.
d. Lifetime Screen Licenses
From time to time, HipDeck may offer "Lifetime" screen licenses as part of a limited promotion or special offer. When available, a Lifetime Screen license guarantees access for a minimum of 3 months from the date of purchase. After this period, continued access will be provided for the duration of the application's active development and availability. If HipDeck discontinues the Service within the initial 3-month period, a full refund will be issued to affected customers. Beyond this window, no refunds will be provided. These offers are not recurring and may be discontinued at any time at HipDeck’s sole discretion. Lifetime access is subject to the same terms of use and acceptable use policies that apply to all users.
3. User Content
a. Ownership
You retain ownership of the content you upload to the Service. By uploading content, you grant HipDeck a limited, non-exclusive, worldwide license to store, display, and distribute the content solely to provide the Service.
b. Responsibility for Content
You are responsible for the content you upload. You represent that you have the necessary rights to upload and share the content through the Service.
4. Intellectual Property
a. HipDeck Ownership
All intellectual property rights in the Service, including but not limited to software, design, trademarks, and content, are owned by HipDeck or its licensors. You agree not to reproduce, modify, or distribute any portion of the Service without our prior written consent.
b. Feedback
If you provide feedback, suggestions, or ideas about the Service, you agree that we may use this information without obligation to you.
5. Termination
We reserve the right to suspend or terminate your access to the Service at our discretion if you violate these Terms or engage in activities that may harm the Service or other users.
6. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Service, including but not limited to the accuracy, reliability, or availability of the Service.
7. Limitation of Liability
To the fullest extent permitted by law, HipDeck shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.
8. Indemnification
You agree to indemnify and hold harmless HipDeck, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or liabilities arising from your use of the Service or violation of these Terms.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website or sending an email. Your continued use of the Service after any modifications indicates your acceptance of the new Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction where HipDeck is based, without regard to its conflict of law principles.
